1. Acceptance of Terms

By accessing or using Status Blocks ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using the Service on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms.

2. Description of Service

Status Blocks provides a SaaS platform for monitoring and displaying the status of your applications and services. Features include status pages, metrics tracking, event logging, user analytics, and funnel analysis. The specific features available to you depend on your subscription plan.

3. Accounts and Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must notify us immediately of any unauthorised use of your account.
  • You may not use another person's account without permission.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Payments

Some features of the Service require a paid subscription. By subscribing to a paid plan:

  • You agree to pay the applicable fees as described on our pricing page.
  • Payments are processed securely through our payment provider, Paddle. Your use of the payment service is subject to Paddle's terms of service.
  • Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
  • Fees are non-refundable except where required by applicable law.
  • We reserve the right to change pricing with reasonable notice. Changes will apply at the next billing cycle.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Infringe upon the rights of others
  • Transmit malicious code, viruses, or harmful data
  • Attempt to gain unauthorised access to the Service or its related systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Use the Service to collect or store personal data in violation of data protection laws
  • Resell or redistribute the Service without our written consent
  • Use the Service in any manner that could damage, disable, or overburden our infrastructure

6. Your Data

You retain ownership of all data you submit to the Service ("Your Data"). By using the Service, you grant us a limited licence to process Your Data solely for the purpose of providing and improving the Service.

You are responsible for the legality, reliability, and appropriateness of Your Data. You must ensure that you have all necessary rights, consents, and legal bases to submit data to the Service, particularly where personal data is involved.

Our handling of personal data is described in our Privacy Policy. Where we act as a data processor on your behalf, our Data Processing Agreement applies.

7. Data Protection and GDPR

We are committed to complying with applicable data protection laws, including the General Data Protection Regulation (GDPR) where applicable.

  • When you use Status Blocks to process personal data of your own users, you act as the data controller and we act as the data processor.
  • The terms of our data processing are set out in our Data Processing Agreement (DPA), which forms part of these Terms.
  • You are responsible for ensuring that your use of the Service complies with applicable data protection laws, including obtaining necessary consents from your users.

8. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Status Blocks and is protected by copyright, trademark, and other intellectual property laws. Our trademarks may not be used without our prior written consent.

9. Service Availability and Support

We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. We may perform scheduled maintenance with reasonable notice. Support is provided according to your subscription plan level.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Status Blocks shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

Our total liability for any claims arising from or relating to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Termination

You may terminate your account at any time by contacting us or through your account settings. We may terminate or suspend your access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use the Service will cease immediately. We will delete your data in accordance with our data retention policies and applicable law.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of the applicable jurisdiction.
